Exploring Digital Vulnerability in EU Law

Michelle Liu, a PhD candidate at the Radboud Business Law Institute, has published her latest article, titled Digital Vulnerability: Rethinking Power Imbalances in the Digital Age in the European Review of Private Law (ERPL).

In her article, Michelle examines whether EU law sufficiently addresses the power imbalances that have intensified in the digital age. She scrutinizes the underlying assumptions in EU law regarding a subject’s weaker position and the causes of such vulnerabilities, particularly concerning consumers and data subjects. By identifying gaps in how EU law perceives and tackles these imbalances, she suggests critical factors that should be considered to accurately capture the nuances of digital vulnerability.

Furthermore, the article proposes practical solutions aimed at remedying the enhanced power imbalances brought about by digitalization. Michelle’s work contributes to the ongoing discourse on rethinking foundational concepts in European private law to better meet the challenges posed by the digital era.
